Pultika Service User Agreement
This is a translation for convenience; the Russian text prevails. The binding version is published at https://pultika.autos/terms/.
Please read this text carefully before using the Pultika service. The Agreement sets the rules for using the Service and is an integral part of the Public Offer for a Licence Agreement. Personal data processing is governed by the Personal Data Processing Policy.
1. Status of the Agreement and accession to it
1.1. This User Agreement (the "Agreement") is concluded between Tabix Limited Liability Company (OGRN 1187746090740, registered on January 29, 2018; INN 9705114726; KPP 771901001; the "Rights Holder") and the individual using the Pultika service (the "User"). The Rights Holder and the User are together referred to as the "Parties".
1.2. Capitalised terms (Service, App, Website, Account, Session, Vehicle, Onboard Module, Vehicle Data, Command, Command Log, Owner, Trusted User, Verification Code, Number Verification, Registration) are defined in Section 1 of the Offer and Section 2 of the Policy and have the same meaning in the Agreement.
1.3. The Agreement is a contract of adhesion (Article 428 of the Civil Code of the Russian Federation) and an integral part of the licence agreement concluded by accepting the Offer. The set of service documents consists of the Offer, the Agreement and the Policy; in case of conflict the Offer prevails, then the Agreement, then the Policy; personal data processing is governed solely by the Policy.
1.4. The User accedes to the Agreement at the moment of Registration — the first Number Verification, completed by entering the Verification Code or by calling from the phone number they provided. Links to the Offer, the Agreement and the Policy are shown on the App's sign-in screen before Number Verification is completed and are published on the Website. Where Number Verification is completed with a Verification Code, the Code is the User's simple electronic signature (Articles 5 and 9 of Federal Law No. 63-FZ of 6 April 2011 "On Electronic Signatures"); where it is completed by call, the User is identified by the phone number the call was made from, as recorded by the telephony provider. The Parties acknowledge that Number Verification by either method confirms that the phone number belongs to the User, that the User accedes to the Offer and the Agreement and that the User has read the Policy. The User's personal data is processed on the grounds stated in the Policy; Number Verification is not consent to personal data processing.
1.5. Only an individual aged 18 or over with full legal capacity may use the Service. By signing in, the User confirms that they meet this requirement. The Rights Holder may block an Account created by a person under 18; the legal representatives of a minor are responsible for the minor's use of the Service.
1.6. A User who does not agree with the Agreement, the Offer or the Policy may not use the Service and must delete the Account as described on the Delete account page.
2. Description of the Service
2.1. The Service lets the User, on a mobile device, receive Vehicle Data (charge level, range, the state of doors, windows, locks, climate, tyres, location and trips), send Commands to the Vehicle (lock or unlock, open or close windows, sunroof and trunk, turn the climate system on or off and other available functions) and view the Command Log. The set of functions depends on the Vehicle model, the Onboard Module and the App version and may be changed by the Rights Holder.
2.2. The Rights Holder is the developer of the App and the server side of the Service. The Rights Holder is not the manufacturer of the Vehicle, nor its importer, dealer or authorised representative, is not affiliated with them, and the Service is not the Vehicle manufacturer's official app. The Vehicle manufacturer is not responsible for the Service, and the Rights Holder is not responsible for the Vehicle, its factory software or the manufacturer's warranty obligations.
2.3. The Service receives Vehicle Data and sends Commands only through the Onboard Module and the cellular network. The Rights Holder does not control the Vehicle, its onboard systems, the Onboard Module or communication channels and does not guarantee that the Vehicle will be online at any given moment. The Onboard Module is installed in the Vehicle by the Rights Holder or a third party; the terms of its installation and servicing are not governed by the Agreement.
2.4. The Service is not a security, anti-theft, tracking or emergency alert system, does not replace the Vehicle's standard equipment (key, dashboard, alarm) and is not intended for decisions on which life, health or the safety of property depends.
2.5. The User checks with the Vehicle manufacturer or dealer whether installing the Onboard Module and using the Service affects the manufacturer's warranty, and bears the related risks.
3. Account and sign-in
3.1. Sign-in uses a mobile phone number through Number Verification. The User enters the number and chooses a method: a call from that number to the number shown in the App (the primary method), or a Verification Code delivered via a messenger or by SMS (the fallback method), which the User enters in the App. There is no separate sign-up form: the Account is created automatically on Registration — the first Number Verification.
3.2. The User may only use a phone number that belongs to them. One phone number corresponds to one Account. If the number is transferred to another person or lost, the User must immediately notify the Rights Holder at support@lisik.tech so that the new subscriber cannot access the Account.
3.3. The Verification Code is valid for a limited time and may be used once. The Rights Holder may limit how often a Code can be requested and how often Number Verification can be attempted, how many Code entry attempts are allowed, and may temporarily block sign-in in case of abnormal activity.
3.4. For Number Verification by call, the User must call from the phone number they provided, must not hide their number (verification fails if caller ID is withheld) and must make the call within the time limit shown in the App. The cost of the call is set by the tariff of the User's mobile operator; as a rule, the call is disconnected before billing starts. The Rights Holder is not responsible for a delay in connecting the call or for the User's mobile operator refusing to connect it.
3.5. The User must keep the Verification Code and PIN secret, not hand a signed-in device to third parties, and use the device's protection features (screen lock). All actions performed in the Account are deemed performed by the User until the User informs the Rights Holder that they have lost control of the Account.
3.6. The User may be signed in on several devices at once. All Sessions are terminated on request to support or when the Account is deleted.
3.7. The Rights Holder may terminate Sessions and block the Account on reasonable suspicion of unauthorised access, notifying the User by an available means.
4. Vehicles, the Owner and Trusted Users
4.1. A Vehicle is assigned in the Service to an Owner when the Onboard Module is installed: the person installing the Onboard Module (the Rights Holder or a third party) assigns the Vehicle, by its VIN, to the Account named by the person who presented the Vehicle for installation. That Account becomes the Owner's Account.
4.2. The Owner warrants that they own the Vehicle or possess it on a lawful basis and are authorised to connect it to the Service, receive Vehicle Data and send Commands. The Rights Holder may request supporting documents and suspend access until they are provided.
4.3. The Owner may grant other Users (Trusted Users) access to the Vehicle and revoke it at any time by means of the Service or by contacting support. A Trusted User can view Vehicle Data and send Commands to the extent determined by the Service.
4.4. The Owner grants access at their own risk and is liable for the actions of Trusted Users in relation to the Vehicle as for their own. The Owner must grant access only to people they trust to operate the Vehicle, and revoke it when that trust is lost, circumstances change or the relationship with the Trusted User ends. A Trusted User nevertheless remains a party to the Agreement in their own right and is responsible for their own actions.
4.5. The Owner must inform anyone they let use the Vehicle (including people who are not Users) that the Vehicle's location and trips are recorded by the Service and visible to the Owner and Trusted Users. Using the Service to covertly monitor people is prohibited.
4.6. When selling the Vehicle, handing it over to a third party for long-term use or removing the Onboard Module, the Owner must first revoke all Trusted Users' access and inform the Rights Holder that the Vehicle is to be disconnected from the Service. Until that notice is received, the Rights Holder treats the Owner as the person entitled to receive Vehicle Data. The Vehicle is re-assigned to a new Owner on request to support; trips recorded before the transfer are not shown to the new Owner.
4.7. Vehicle Data belongs to the Vehicle. When the Owner's or a Trusted User's Account is deleted, Vehicle Data stays with the Rights Holder for as long as the Vehicle is connected to the Service (see Delete account).
5. Commands and Vehicle Data: safety
5.1. A Command is executed by the Vehicle, not by the Service. The Service only relays the Command to the Onboard Module and shows the reply it receives. Whether, when and how a Command is executed depends on connectivity with the Vehicle, the state of its onboard systems and battery, the Vehicle's sleep mode, its factory software and external conditions. The Rights Holder does not guarantee that a Command will be delivered or executed, or executed within any particular time.
5.2. The absence of a reply from the Vehicle does not mean the Command was not executed; an error message does not mean the Command was not partly executed. Where the safety of people or property depends on it, the User must verify the actual result of the Command (for example, that the locks are engaged) by means available to them.
5.3. Before sending a Command, the User must make sure its execution is safe, in particular:
5.3.1. not lock or unlock, open or close windows, the sunroof or the trunk if doing so could endanger people or animals in or near the Vehicle or damage property;
5.3.2. not turn on the climate system, heating or other functions if people or animals who cannot leave on their own are in the Vehicle, or if the Vehicle is in an enclosed space where this could be dangerous;
5.3.3. not send Commands to a Vehicle that another person is driving at that moment without their knowledge;
5.3.4. not use the App while driving.
5.4. Lock Commands are confirmed with a PIN or biometrics on the User's device. The User may not disable or bypass this protection.
5.5. Vehicle Data is generated by the Vehicle and the Onboard Module and is displayed by the Service without verification. It may be incomplete, outdated (reflecting the state at the Vehicle's last connection), inaccurate or differ from the Vehicle's dashboard. Range and charge level are estimates. The Vehicle's location is determined by the Onboard Module with some error and may be unavailable (for example, in underground car parks). The User must not rely on Vehicle Data for safety-related decisions without verifying it by other means.
5.6. The Command Log is kept to inform the User and to investigate requests. Command Log entries reflecting the Onboard Module's reply are sufficient evidence that a Command was sent and what reply was received, but not that the Vehicle executed it.
6. Rules of use
6.1. The User undertakes to use the Service only for its intended purpose and in accordance with the law of the Russian Federation, the Agreement, the Offer and the Policy.
6.2. The User may not:
6.2.1. use the Service in relation to a Vehicle they are not entitled to dispose of, or to which the Owner has not granted them access;
6.2.2. use the Service to monitor people without their knowledge, to violate third parties' rights or to commit offences;
6.2.3. interfere with the operation of the Service or the Onboard Module, bypass protection measures, send Commands other than through the App, automate requests to the server side without the Rights Holder's written consent, or create excessive load;
6.2.4. decompile, disassemble or modify the App, or study the protocol of its interaction with the server side or the Onboard Module, except as expressly permitted by Article 1280 of the Civil Code of the Russian Federation (see Section 6 of the Offer);
6.2.5. transfer the Account, Sessions or Verification Codes to third parties, or create Accounts with other people's phone numbers;
6.2.6. use the Service to provide commercial services to third parties without a separate agreement with the Rights Holder.
6.3. The Rights Holder may suspend or terminate the User's access for a breach of 6.2 in accordance with Section 10.
7. Intellectual property
7.1. The App, the server side of the Service, the Website, their design, texts, graphics, the name "Пультика" / Pultika and the logo belong to the Rights Holder. The User receives only the right to use the App within a simple (non-exclusive) licence on the terms of the Offer.
7.2. Vehicle Data and the Command Log are not subject to the Rights Holder's intellectual property rights; the User may use the information shown to them in the App for personal purposes.
8. Notices and communication
8.1. The Rights Holder sends the User service messages about the Service and the Vehicle (for example, that the Vehicle has not connected for a long time, that a Session has ended, or that service documents have changed) through the App, by SMS or via a messenger to the User's phone number, or by publication on the Website. The Rights Holder does not send advertising.
8.2. The User's requests to the Rights Holder are sent to support@lisik.tech. Legally significant notices (claims, termination notices) are also sent in writing to the Rights Holder's address given in Section 14.
8.3. A message is deemed received by the User on the day it is displayed in the App, delivered to the phone number or published on the Website; publication of a notice on the Website constitutes proper notice to the User. A message is deemed received by the Rights Holder on the day it arrives at the email address (for claims — on the day the letter is received at the Rights Holder's address).
9. Disclaimer of warranties and limitation of liability
9.1. The Service is provided "as is" and "as available". The Rights Holder does not guarantee uninterrupted and error-free operation of the Service, its compatibility with a particular device, Vehicle model or software version, that the Vehicle will be online at all times, or that Vehicle Data is complete, accurate and up to date.
9.2. The Rights Holder is not liable for:
9.2.1. the consequences of the Vehicle executing or failing to execute Commands, including Commands sent by the User in breach of 5.3 and Commands sent by Trusted Users;
9.2.2. decisions the User makes on the basis of Vehicle Data;
9.2.3. the operation of the Vehicle, its factory software, the Onboard Module, communication networks, app stores, the device's operating system, Verification Code delivery providers, the telephony provider and the User's mobile operator;
9.2.4. the actions of third parties who gained access to the Account as a result of the User's breach of Sections 3 and 4;
9.2.5. inability to use the Service for reasons beyond the Rights Holder's control, including force majeure, actions of state authorities and blocking of communication networks.
9.3. To the extent permitted by law, the Rights Holder's liability to the User is limited to actual damage caused by the Rights Holder's culpable actions, up to the amount of the licence fees paid by the User for the 12 months preceding the event, but not less than RUB 30,000 (thirty thousand roubles). Lost profit is not compensated.
9.4. Nothing in the Agreement excludes or limits the Rights Holder's liability where such exclusion or limitation is prohibited by law, including for intentional breach and for harm to life or health.
9.5. The User compensates the Rights Holder for documented losses caused by the User's breach of the Agreement or of third parties' rights, and settles third-party claims related to such breach on their own.
10. Suspension, termination and Account deletion
10.1. The User may stop using the Service and delete the Account at any time in the App (Profile → Delete account) or by request to support@lisik.tech. The procedure and consequences are described on the Delete account page: access to Vehicles is revoked, Sessions are closed, the Command Log and connectivity log are anonymised and the Account is deleted within 30 days; Vehicle Data remains for as long as the Vehicle is connected to the Service.
10.2. Deleting the Owner's Account does not by itself disconnect the Vehicle from the Service. An Owner who wants to stop collection of Vehicle Data or Trusted Users' access to the Vehicle must revoke access and give notice of disconnection under 4.6 before deleting the Account.
10.3. The Rights Holder may suspend access to the Service or individual functions for maintenance, notifying the User in advance through the App, by SMS, via a messenger or by publication on the Website where possible.
10.4. The Rights Holder may suspend the User's access or block the Account if the User breaches the Agreement, the Offer or the law, on reasonable suspicion of unauthorised access, or at the request of an authorised body, notifying the User and stating the reason; in case of a material breach, the Rights Holder may terminate the licence agreement unilaterally out of court (Article 450.1 of the Civil Code of the Russian Federation).
10.5. The Rights Holder may discontinue the Service as a whole, notifying Users through the App and on the Website at least 30 calendar days in advance.
11. Changes to the Agreement
11.1. The Rights Holder may amend the Agreement. A new revision is published on the Website at https://pultika.autos/terms/ with the revision date and takes effect no earlier than 7 calendar days after publication; Users are notified of changes through the App, by SMS, via a messenger or by publication on the Website. Changes that correct errors or improve the User's position may take effect on publication.
11.2. Continued use of the Service after the new revision takes effect constitutes the User's agreement to it. A User who disagrees with the changes may withdraw from the Agreement by deleting the Account.
12. Governing law and dispute resolution
12.1. The Agreement is governed by the law of the Russian Federation. The Service is intended for users located in the Russian Federation; a User using the Service elsewhere is responsible for complying with local law.
12.2. Before going to court, a Party sends the other Party a claim. The User's claim is sent to support@lisik.tech or in writing to the Rights Holder's address; the Rights Holder's claim is sent through the App or to the User's phone number. The response period is 30 calendar days from receipt.
12.3. If no agreement is reached, the dispute is referred to the court at the Rights Holder's location, unless mandatory law provides for a different jurisdiction, including consumer protection law giving the User the right to choose the court.
13. Final provisions
13.1. If any provision of the Agreement is held invalid, the remaining provisions remain in force.
13.2. The Agreement is drawn up in Russian. Translations into other languages are published for convenience; in case of discrepancy the Russian text applies.
13.3. The current revision of the Agreement is always available at https://pultika.autos/terms/.
